Resumex Terms of Service

Welcome to Resumex ("Resumex," "the App," "we," "us," or "our"), provided by Hygor Dias ("Developer," "I"). These Terms of Service ("Terms") govern your access to and use of the Resumex application, website, and services (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use our Services.
1. User Accounts
Eligibility: You must be at least 16 years of age, or the age of legal majority in your jurisdiction if older, to create an account and use our Services. The Services are not designed for or intentionally targeted at minors.
Account Creation: To use certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Account Responsibilities: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for the veracity and accuracy of all data you input into the Services.
Prohibited Account Activities: You may not create multiple free accounts to circumvent limitations or abuse the free tier of service. Sharing accounts between multiple individuals is prohibited.
2. Description of Services
Resumex provides AI-powered tools to help users create resumes, cover letters, and manage their job application process.
2.1. Free Tier
Users on the Free Tier ("Free Users") are entitled to:
- Create and manage their user profile.
- Create and manage their "User Stories" (detailed notes about experiences).
- Create up to five (5) resumes "from scratch" using manual input mode.
- Access and use a limited selection of approximately eight (8) free resume templates for manually created resumes. PDF downloads of these resumes will not contain watermarks.
- Full access to the job board feature for organizing and tracking job applications.
Limitations: Free Users cannot use AI-powered features for generating or tailoring resumes/cover letters based on job posts, AI-driven content suggestions, or advanced AI editing tools. Access to premium templates is restricted.
2.2. PRO Tier
Users who subscribe to a PRO Tier ("PRO Users") receive access to all features available to Free Users, plus:
- AI-Powered Content Generation: Generate resumes and cover letters using AI to match "User Stories" and profile data with specific job post descriptions.
- AI Usage Limits: AI-powered features are subject to usage limits based on the selected PRO plan. These limits are in place to ensure service quality, prevent abuse, and manage operational costs. Usage is generally designed to be sufficient for typical job-seeking activities within the subscription period. Excessive usage beyond a fair use threshold (internally monitored based on a portion of the subscription cost allocated to AI processing) may result in temporary restrictions on AI features until the next billing cycle or an option to upgrade.
- Premium Templates: Access to all available resume and cover letter templates, including premium designs.
- Unlimited PDF Downloads: Download unlimited generated documents without watermarks.
- Advanced AI Tools: Access to advanced AI tools within editors, such as content rephrasing, tone adjustment, and other AI-driven suggestions.
3. PRO Tier Subscriptions & Payments
Subscription Plans: We offer PRO Tier access through various subscription plans (e.g., 1 week, 1 month, 3 months), as detailed on our pricing page.
Billing and Auto-Renewal: PRO subscriptions are billed in advance on a recurring basis according to the selected billing cycle (weekly, monthly, or every three months). Your PRO subscription will automatically renew at the end of each billing cycle unless you cancel it. You authorize us to charge your selected payment method for these recurring fees.
Payment Processing: All payments are processed through our third-party payment processor, Stripe. We do not collect or store your full payment card details.
Cancellation: You may cancel your PRO subscription at any time through your account settings or via the Stripe customer portal linked from your account. If you cancel, your PRO access will continue until the end of your current paid billing period, and you will not be charged for subsequent periods.
Refund Policy: All payments for PRO subscriptions are non-refundable. We do not provide refunds or credits for any partial subscription periods or unused Services, unless otherwise required by applicable law.
Price Changes: We reserve the right to change the prices for our PRO subscription plans. We will notify existing PRO Users of any price changes at least thirty (30) days in advance, typically via email. Price changes will apply to subsequent billing cycles. If we introduce a new pricing structure or product, existing subscriptions will continue at their original price until the end of their current paid period. At that point, auto-renewal may be disabled, and you will need to subscribe to a new plan at the new price if you wish to continue PRO access.
Failed Payments: If your payment method fails, we may suspend your access to PRO features until payment is successfully processed.
4. Acceptable Use Policy
You agree not to misuse the Services or help anyone else to do so. You agree not to:
- Upload, share, or generate any content that is illegal, harmful, fraudulent, infringing, defamatory, harassing, or obscene.
- Infringe upon the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Services, including our AI models or prompts, except to the extent that applicable law expressly prohibits such a restriction.
- Use the Services for spamming, phishing, or sending unsolicited communications.
- Interfere with or disrupt the integrity or performance of the Services or third-party data contained therein.
- Attempt to gain unauthorized access to the Services or their related systems or networks.
- Use the Services for any purpose other than personal job-seeking and career development.
5. User-Generated Content
Your Content: You retain all ownership rights to the personal information, "User Stories," and other content you input into the Services ("Your Content").
Our License to Your Content: By using the Services, you grant Resumex a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify (e.g., for formatting), process, adapt, publish, transmit, and display Your Content solely for the purpose of providing, maintaining, and improving the Services for you. This includes using Your Content with AI models to generate resumes, cover letters, and other outputs as requested by you.
AI-Generated Documents: For documents (resumes, cover letters, etc.) generated by the AI using Your Content ("Generated Documents"), Resumex grants you a license to use these Generated Documents for your personal, non-commercial job-seeking purposes.
No Use for Service Improvement Without Consent: Consistent with our Privacy Policy, we do not use Your Content or Generated Documents to train our general AI models or to improve the Services for other users, unless we obtain your explicit consent for such specific purposes or use anonymized, aggregated data that cannot identify you.
6. AI Usage and Disclaimers
The AI-powered features of Resumex are designed to assist you in creating professional documents. While we strive for accuracy and effectiveness, AI-generated content may sometimes contain inaccuracies, errors, or may not be perfectly suitable for every situation.
You are solely responsible for reviewing, editing, and verifying all content, including AI-generated content, before using it for job applications or any other purpose. Resumex is not responsible for any decisions you make based on the AI-generated content.
The effectiveness of generated documents in securing job interviews or employment is not guaranteed.
7. Intellectual Property Rights
Our Intellectual Property: The Services, including the Resumex application, its visual design, branding, features, underlying technology, AI models, prompts, and all related intellectual property rights, are and will remain the exclusive property of Hygor Dias. These Terms do not grant you any right, title, or interest in the Services, other than the limited license to use the Services as expressly permitted herein.
Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Services ("Feedback"), you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free right to use, copy, modify, create derivative works based upon, and otherwise exploit such Feedback for any purpose, without any obligation or compensation to you.
8. Termination
Termination by You: You may terminate your account and stop using the Services at any time through your account settings. Upon termination, your data will be handled in accordance with our Privacy Policy.
Termination by Resumex: We may suspend or terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. Grounds for termination may include, but are not limited to: (a) a breach of these Terms; (b) non-payment of PRO subscription fees; (c) engaging in illegal or fraudulent activities; (d) prolonged inactivity (e.g., 6 months or more for free accounts); or (e) if required by law.
9. Disclaimers of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE MAKE NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SERVICES, INCLUDING AI-GENERATED CONTENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
Resumex DOES NOT GUARANTEE THAT USE OF THE SERVICES WILL RESULT IN JOB OFFERS OR EMPLOYMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HYGOR DIAS (OR Resumex) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES, INCLUDING AI-GENERATED CONTENT; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNTS PAID BY YOU TO US FOR THE USE OF THE PRO SERVICES IN THE LAST THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
11. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles.
Dispute Resolution: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms or the breach thereof, the parties hereto shall use their best efforts to settle the dispute, claim, question, or disagreement. To this effect, they shall consult and negotiate with each other in good faith and, recognizing their mutual interests, attempt to reach a just and equitable solution satisfactory to both parties. If they do not reach such solution within a period of sixty (60) days, then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled by mediation administered in accordance with the rules of a recognized Canadian mediation service agreed upon by the parties. If the parties cannot agree on a mediator or mediation service, one will be appointed by a court of competent jurisdiction in Canada.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will notify you of changes by sending an email to the address associated with your account, by posting a notice within the Services, or by requiring you to re-accept the updated Terms. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
